Legal Question in Consumer Law in Georgia

Hello\nI have quick question. I recently went to a car lot and and got a 04 GMC Yukon.\nMy total down payment was $2,400 , I gave them 1,500 to drive off the lot. There were three more pickup payments of $ 300.00 to made for a sum of 2,400. Now I made my first payment and sent a check for the two remaining payments,because I was out of town on family business. Then one day my girlfriend called me and informed me that the truck was gone . So I called the car lot just to make sure everything was ok. Thats when one of the sales guys told me they had the truck.When I asked what happened, he told me they haven\'t recieved the pickup payments. I explained to him that I sent the check, thats when he told me they weren\'t going to be able to accept the check, and I wouldn\'t be able to get the truck nor my down payment back . Now in sayin all that, I want to know if have any legal rights.

No one here knows what your contract stated about the due dates for the payments, and you did not tell us. Read your contracts. "I mailed the check" or "I was out of town" is not an excuse for missed payments.
