Legal Question in Consumer Law in Georgia

Hello my husband purchased a car 6/24/10 from someone in California. They have been giving us the run around on giving us things to make the car legal in Georgia. First it took them 2 weeks to send the title after we received the car. When we received the title it was a Salvage title (which was not disclosed) and it was not properly filled out. We had to send the title back to have it properly done. Upon receiving the title the 2nd time, we were told we had to have a special state inspection done at the cost of 100.00. It did not pass, my husband had to put 900.00 worth of work into the car in order to get it to pass. The car was advertised as being in excellent condition. Then we had to send 118.00 in order to get the Salvage title changed over to a regular title. The Revenue office sent us a letter stating that taxes had to be satisfied and that we need a Bill of Sale to show it. We contacted the seller and he sent us a Vehicle Transfer and Reassignment Form, with name of someone totally different as the seller and no mention of taxes. The Dept. of Revenue said that was not correct. They said the seller's name needs to be the same on both documents ( Title, BOS) and that it needs to be a bill of sale. The car is valued at 4150. and we paid 5950. for it, so the taxes are more than satisfied, the state agreed, but the BOS needs to reflect this. The Revenue Dept also said if we can not get the BOS we have to pay 300.00.

We are in danger of loosing our car or at the least not being able to drive it, because we can not get it registered.

This person says he sells cars as a side job, so we assumed he knows what he is doing. Since nothing has been done properly, we must assume he is acting with malice. This person also seems to have several alias.

What if any is our legal recourse?

You may consider hiring a California lawyer to threaten and perhaps ultimately file a small claim lawsuit against the seller for breach of contract. Best of luck.******The above is for informational purposes only and does not create an attorney-client privilege.******
