What makes a contract void?
I signed up for a membership with a gym in my area. My contract stated that my monthly fee was suppose to be taken directly out of my checking account on the 23rd of every month. They have taken it out on the 20th, the 22nd, and the 20th again. I contacted the gym, and said there was nothing they could do about it. Because I thought the money was going to be coming out on the 23rd, it caused my checking about to become overdrawn. Should they be responsible for the fee that my bank charged me, and does them taking the money out too soon make the contract void?

Without reviewing the contract, I cannot give you a definite answer, but you would have a good case to terminate the contract and sue for the bank charges if the contract states specifically that the draw would be made on the 23rd of each month.
