Merchandise received damaged
I ordered furniture from a local furniture store - delivery was 3x advised due to a problem with the fabric. Chairs arrived damaged I immediately notified store. In the 12 weeks before they picked it up one chair began to squeak. The store was notifed each time some new problem developed. The furniture was returned after 5 weeks and although some improvement had been made in the foam, it still squeaked and the seat cushions were colapsing. I sent a letter asking for a refund as it had been at that point 6 months since I purchased and I still did not have a non-defective product. They ignored my letter, I then sent a complaint through the BBB and they also ignored this letter - I have filed a suit with Mag, court. Their reply was that I never called them to get them to pick up the furniture to send it back to the factory! It has now been over one year since I purchased this furniture and I have had nothing or junk in my living ever since. What are my chances? What law can I use? Isn't this fraud? Thanks for any help -
