Legal Question in Consumer Law in Georgia

Do I still have to pay for the Ring?

As a Christmas present for my wife, I was looking for a special ring. A oval emerald with smaller diamonds on the side. A local Jeweler said he could make the ring for me for $1600. I paid him $500 deposit and we agreed I would pay him $200 until it was paid in full with no interest. When I gave the ring to my wife, it turns out she didn't like it at all & even though she really appreciated the thought, she didn't like the ring & didn't feel like she would wear it. She took the ring back to the store. We expected to loose the $500 deposit but the jeweler is saying we must take the ring & still owe him the balance. I did not sign anything. He has the ring now. Do I Have to pay him the balance?

Re: Do I still have to pay for the Ring?

From your post, it looks pretty straightforward -- you bought a ring, and agreed to pay a certain price on certain terms. On what basis do you think there is another agreement, such as returning it and losing the deposit, or returning it for a partial refund if your wife does not like it? Do you have something that reflects this is the store policy? It looks like you made a pretty clear agreement. Further, it should almost be expected that even when a store does have a return policy, it probably will not apply to special orders or something they made especially for you. If you thought it was possible you may want to return it, you should have not entered into an agreement that apparently did not allow returns.
