Legal Question in Consumer Law in Georgia

I purchased a car for my son from a private seller under the impression that the car had low miles, was in good condition and had cold a/c. Just had my mechanic check out the car and found that it needs work that was not disclosed including a new a/c compressor as it is leaking. The cold air was apparently because they had it recharged before we bought it. Do I have any recourse?

We don't have your agreement, and you did not tell us what it is. Did you have a warranty? Otherwise, purchases are generally "as is." The time to get a car checked by a mechanic is before you purchase.

Unless you bought it with a warranty, you bought it as is and have no recourse. You never purchase a used car without an inspection in advance.

I would have to agree, UNLESS the seller committed some sort of fraud. Its very hard to prove. The fact that they had the air conditioner recharged suggests they knew there was a problem. However, this fact does not prove anything. For all you know, their mehanic told them that the air conditioner was leaking and they were told that all it needed was re-charged. They might not have known that the problem was with the air compressor. They are not an insurer.

You might do some probing - there are still a few good hearted souls out there who might be willing to chip in for some of the needed repairs. However, if they say no, that is the end of it unless there was some kind of fraud (as in they knew about the problem and deliberately tried to hide it from you. There mechanic would have to be willing to say this).

Before you buy - always always always get a Car Fax report and have the car checked out by your own independent mechanic. Don't be cheap - pay for the inspection as it will be worth it.
