Legal Question in Consumer Law in Georgia

Purchased item on ebay and have not received item. Ebay said they cannot do anything about it and told me to file a "complaint" on ic3.gov. normally i would let this go, but the purchase in question is a thousand dollars...

what kind of legal action would best fit my situation. the seller on the site is definately going to be hard to find...

should i take legal action against seller or against ebay?

I have bad news for you. You've learned an expensive lesson. The only way you ever purchase online is by credit card. If you stick to that, you can always do a chargeback. Anything else, frankly is foolish and to send $1000 to someone you don't know on eBay is frankly beyond foolish.

You never send checks or money orders, and never use debit cards, and never wire money.

Ebay has a remedy by the way. On ebay if you stick to only buying items with PayPal or ebay protection, you would have gotten a rebate. They even warn you to not use sellers without that. I assume you chose to buy an item without such protection. You might risk that on a dollar item, but no one would do that for $1000.

No, you can't sue ebay, and unless you can find the seller you can't sue them either. Even if you can find the seller, unless you also know what assets the seller has, a suit is a waste of time. Bear in mind you have to sue where the seller is.
