Legal Question in Consumer Law in Georgia
I recently paid for a vehicle warranty in full to a car dealership but once i called to make a claim the warranty holders told me that they never received payment on the warranty and that i needed to contact the car dealership. He set up an account but for some reason they never got the money so im am out of $1500 is this a case that i should take to small claims court?

If they don't fix your car for free and then get you the warranty, definitely.
Before we jump into a lawsuit, your issue is with the dealer, not the warranty company. Get a written statement from the warranty company that they are not honoring the warranty because the dealer did not pay for it. Go to the dealer and show it to him.
These warranties are more often that not junk anyway unless it was a warranty from the manufacturer of the car. The problem is that the money was probably financed through your car note. You can ask the dealer for return of your funds and go get your car fixed. Maybe the dealer will agree to fix your car for free in lieu of giving you your money back. I cannot say, but I have to disagree with Attorney Ashman that the dealer will fix your car AND get you a free warranty.
As I said, car warranties in most cases are junk - you are better off lookingfor your own warranty through either the manufacturer of the car or possibly the car lender or car insurer.
