Legal Question in Consumer Law in Georgia
Refund for services not rendered
I signed a year long contract with a non-profit boxing gym for my son to take classes. After a few months my son decided he did not want to go anymore, however I continued to make my payments every month on time. I was informed a month ago that the gym closed three months prior even though my account was still being debited for the fee. I brought it to the attention of the owner who claimed that when the gym closed she cancled contracts and stopped automatic payments which was not the case here. She confirmed with the company that was debiting my account that they had taken my money but claimed they didn't know where the funds were sent, and at one point told me she would be sending me a check (all via email), yet I have not recieved anything. I want to sue but I am not sure of the cost involved and if I can recover lost wages and the fees associated from the gym owner. What can I do? The amount owed is $180.

Re: Refund for services not rendered
Keep pursuing the refund, since they are closed (not merely because your son quit going). You can also file in small claims court, but if the gym is closed and has no money, you may not have anything to collect. You'll have to decide whether this is worth time, money and effort. I am not sure where you come up with "lost wages and associated fees." If the account being debited was your checking account, this is a reason why it is usually not a good idea to set up debits - use a credit card instead.
