Legal Question in Consumer Law in Georgia
Replace TV
I purchased an 52'' Mitsubishi TV (rear projector) that was ''On Sale'' for aporx. $1100.00 in May of 2006 from Fry's Electronics here in Duluth, GA. The first part of January, I had sound, no picture.
4 attempts were made to repair the TV. All failed and Mitsubishi agreed to replace the TV with a newer model. I have a letter of confirmation for the exchange.
Now, Mitsubishi sent an email to me that they will only give me store credit for what I paid because Fry's stated this was an clearance/open box unit.
Mitsubishi had a copy of my receipt a month prior before making this decision. What are my options?

You failed to even mention any warranty, much less the terms. Clearance or open box items often come with different terms for returns or warranties. You agreed to these terms when you made the purchase, as did the store. Read the documents.

If there is no warranty involved, you might consider getting their attention by suing them in small claims court based on the written agreement you have.
