Legal Question in Consumer Law in Georgia
Can I rescind/cancel a contract for weight loss program within 3 business days and get a full refund of may payment?
1 Answer from Attorneys
No. There is no universal right to cancel purchases. A three-day right to cancel exists for only a limited number of consumer transactions.
For the most part, the three-day right to cancel applies only to credit or cash transactions of $25 or more that were initiated through face-to-face contact (such as door-to-door sales) away from the seller's regular place of business and that resulted in a written agreement. There are specific laws that create a right of recission for a handful of businesses, such as spa memberships and some mortgage loans.
If your contract contains a right to rescind that is not required by law (and a few contracts may), you can only rescind if you follow the exact procedure and time in the contract. Be sure that is in writing and that you can prove the date and time of delivery and keep a copy.
