Restaurant Food Poison

I purchased a burger from a restaurant and ate most of it, and also gave some to my 9 month old baby. We became ill immediately after eating it. I called to inform the store manager, and she would submit a claim and call me back with the claim number, but we still had to go to the hospital the next day because the pain, nausea & diarrhea was so severe. Is there anything I can do, I was diagnosed with Acute Gastritis and given fluids in my veins and medication. My baby was diagnosed with Gastroenteritis. I also have the receipt.

Follow up with the restaurant or upper management - you do not provide a time frame when this happened. Depending on what you mean by "immediately," it might not be their food since food poisioning generally has some incubation period. Also, if no one else got sick that day, or from the same batches of food, they might not be responsible (or admit it). Obviously, no one here has those facts. If it can be pinned on the restaurant, they will likely handle your bills. If you are the only "victim," they might not. Large fast food chains (which we know this is from your prior post) get hit with these claims, valid or not, many, many times a year.
