Legal Question in Consumer Law in Georgia
Return of item from private sale
I recently sold an item through an on-line posting of craigslist. The item was bought and the buyer now wants to return it to me, give me some money for my troubles and get a refund. Initially, I agreed to the return but decided against it once I thought about the circumstances and the item they wanted to return. The item was sold and advertised as used, they seem to have a case of buyers remorse but claim the item is not the size they need, but it is indeed the size I indicated in my ad. They are now threatening to take me to small claims court to force me to refund their money claiming that in the absence of ''all sales final'' in my ad, they are entitled to a reasonable opportunity to return the item. Do they have a case? Can my initial, verbal agreement be enforced in court?

Re: Return of item from private sale
Although you had no obligation to agree to a return, once you agreed to a refund, you are bound by that agreement. If they can prove you made such an agreement, they can enforce it.
