Can you sell something you don't have?
What happens when someone sells something they don't have and they refuse to refund you your money for four months?

Well, you can't sell something you don't own. Representing that you have something for sale and then take money and then can't produce, you open yourself wide open to a lawsuit for fraud, among possible causes of action. Contact a lawyer.

You haven't posted enough details to fully answer but the options usually are:
(1) You swear out a warrant for the person's arrest for theft
OR
(2) You sue them.
