Legal Question in Consumer Law in Georgia
I signed an agreement with a check advance company. Article #8, "Extended Payment Plan" states (in bold type) that, "If you are unable to repay a deferred payment transaction when due, you are eligible to request one extended payment plan in a twelve month period." That is all that is stated in the contract; no conditions, etc. are mentioned at all.
I called the day before my due date to request an extension but was told that they are only extended under extreme circumstances (family member's death, serious illness, etc.). I was told that my account would still be charged and that I would have to pay any additional charges from my banking institution.
I explained to the manager that I was surprised because none of this information was on the contract, which I still have. She did not deny the fact that the contract does not specify any conditions at all, but replied that there was a sign "on the wall" which she offered to read to me. Do I have a case against this establishment?

Ignoring the fact that it is extremely foolish to deal with legal loan sharks that take advantage of people (poayday lenders and check advance places are NEVER okay to deal with), you have no basis to complain.
You say your contract says you are "eligible to request." That means what it says. It means you can ask. It doesn't mean they have to say yes.
Get your "loan" to these despicable bottom feeders paid off TOMORROW and never deal with such people again. If you have to, as these leeches will bleed you, borrow from family and friends but spend tomorrow paying them off.
