Legal Question in Consumer Law in Georgia
Unfinished Work- Plumber
I hired a plumber to redo the piping in my rental property. He said he was licensed and that the job would take 2-3 days, including the sheetrock repair. It has now been 2 months. I live in VA but the house is in GA. He always promised it would be done on such and such date and I drove down twice and it wasnt complete. I also see that his license lapsed prior to starting the little work he did do. Can I sue for the full amt back since he wasnt licensed? As well as extra for fraud? And how about for the gas and time I spent driving down when he assured me it would be done (knowing I was driving down there that weekend then to see the finished work)... and I have had people interested in renting the home, but unable to rent it out because there are holes in the walls, the faucets are off all of the tubs and sinks... no water. Can I be compensated in any way for possible lost rental income? Thank you for any help. I know this is a lot, but I just got laid off and this is costing me so much money and I need to get a tenant in there ASAP!

Your measure of damages is the cost of someone else to finish the job and/or correct any things he did wrong, plus your loss of rental. Heck, throw in your gas and time. The worst that can happen is the judges denies it. Consult with an attorney in the county where the plumber resides. That is where you have to file suit.

The money you paid him for work not done, or the cost to have someone else do the same work, are direct damages. Lost rent is not something to count on, as it is generally speculative and incidental, and travel/gas are unlikely. You can ask for these, but you would not want to count on getting them.
