Wedding Photographer Breaches Contract

I recently got married and hired a photographer for both weddings (Indian and American). We paid $2,200 for 8 hours for the American and $4,000 for Indian wedding. Our photographer was to take pictures during this time. In the contract we see the proofs and pick out 88 pictures for each album. It was also in the contract that he would give us all of the proofs that were not used in the albums free of charge since he did both weddings.

-He showed us only 119 pictures for american and 233 for indian.

-He said he did something new with our wedding and used a digital camera (not in contract) All of those pictures are unavailable unless we spend an extra $350 for each wedding for the CD! An extra 100 american and 200 indian. The pictures were also much better than the ones we could keep.

-I think, based on the contract, every picture he took at the wedding should be ours. Now we will not get those proofs free even though we are supposed to get all proofs not used in albums.

-He also spent all that extra time using his digital camera when he knew we were not getting the pictures.

We already paid him the balance of $3,300 for the proofs and want to stop payment on the checks.

It sounds like he tried to change the terms of the contract, which he can't do. I would stop payment. Failing that, I would take him to small claims court.
