Legal Question in Consumer Law in Georgia

Windshield

Within 15 miles of driving of my newly purchased used vehicle, the windshield cracked while I was at a red light.(It's called a stress crack and while not common, not unusual either). I pulled over and called the dealership immediately and was told not to worry, that he would take care of it. Within the 3 weeks that he put me off, the crack went from 2 inches to well over 12 inches and is in my line of vision. He sent a window repair tech to ''fix'' the crack although he had informed me after seeing the progress of the crack at the two week point that the windsheild would have to be replaced. He even went so far as to set me up an appointment but the rain that day prevented the repair. Since the attempted repair, there is, in my line of vision, an area that is blurred from the repair material and will not come off. Of course, now the dealer is backing up that he said he'd ever fix it. (Yes, I signed an As Is) With documentation of phone calls to and from him during the 3 week period and the receipt where his dealership assigned someone to attempt to fix my windsheild but in fact made it worse, is he now responsible for a proper repair be it another ''window fixer'' or my windshield replaced?

Re: Windshield

I will add that you may get a ticket for driving with an obstructed windshield, and if you are an accident it could be a big factor in assessing liability. It will not be a defense to either that you are waiting on a resolution of any dispute with the dealer.

Re: Windshield

When you buy a car as is there is no responsibility by the dealer to repair anything. You can ask, but it's solely up to him, unless you bought or got a warranty that covers that.
