Legal Question in Credit and Debt Law in Georgia

In or about 1995 I had a capitol one credit card and paid and paid on this til their charges got really bad. I quit paying on it and had told them I was on disability. They didn't care or try to adjust charges. Thats why I stopped paying.

In 2007 they went to civil court and got a order for me to pay their out rageous charges for all those years. I was not notified of a hearing and got served by marshalls office 4 months later about the hearing and judgement . Yesterday got a copy where they ask for production from a finiance company I have a loan with to produce my records.

I have an old car in my name can they take my car? This is the only thing I own and it's worth about a $1000.00.

What if any can I do about this collection agency and this card debt after 14 yrs. and them waiting 12 yrs. to take me to court w/ot proper notification?

In waiting from 2007 until now to deal with this (you admit you had notice in 2007) you screwed up badly, and took a case where you possibly had defenses and turned it into a bad situation.

At this point you need a lawyer. Yes they can take your car, as well as your bank account, etc.

You may want to look into bankruptcy. You have likely lost options you had in waiting years to ask this question.
