Legal Question in Credit and Debt Law in Georgia

I applied and received a loan for $10,000 from my bank and I loan the money to a friend who promise to pay it off( I do have a signed promissory note). He was paying the monthly installments for about half of the loan, then he stopped. My bank took all of the money I had in my account to pay on the loan which was about $1,200.00. I paid the remainder of the loan($3200.94) to keep my good credit rating and now I want to sue him for my money back. I made this loan and agreement to him in another state, but I've moved since then. Can I file to sue him in the state I'm currently living in, or do I have to file in where the transaction took place, and do I need an attorney? Where to file is also a problem. He lives in Mobile, AL and has a house there, but he works in New Orleans, LA, however the transaction took place in New Orleans.

This is the second time you posted this question. As stated by two attorneys the last tim you asked, you should get a lawyer, and you sue him where he lives.

I concur with Attorney Ashman. If he lives in Alabama, you can always sue him there. If he works in Louisiana, you can also sue there as the transaction arose there. Even though he works in New Orleans, some employers, regardless of location, will honor a judgment entered anywhere.

You cannot sue in GA at all unless the friend has other minimum contacts with GA to satisfy the test for jurisdiction.

As I indicated earlier, you should contact an attorney in Alabama and see about suing the friend. You also may want to re-post your question and direct it to Alabama attorneys. GA is really not the place where you will be suing so there is no point in asking GA lawyers about AL or LA law.
