Legal Question in Credit and Debt Law in Georgia
I'm applying for an auto loan through a dealership in Georgia where I am also a resident. They are telling me I have to come in to provide them with my information so they can run the credit check and they cannot take the information over the phone because it is illegal. Another company took my information with no questions asked. Who is correct?

The dealer will have to do a credit check on you if you are applying for an auto loan. You have to authorize this (it would be part of the loan application) so I am not certain how it can be done over the phone unless the dealer is writing the information down. However, you would not be signing anything that way so I don't see how it can be done over the phone. Online, maybe but not purely over the phone. I have heard of some unscrupulous dealers who pull credit without the client's authorization so it would not surprise me that some dealers would do it over the phone.
Why not try a third way and line up your own financing in advance from a credit union if you are a member instead of relying on the dealer?
And before you go letting a dealer pull your credit, have you checked your credit yourself and cleared any issues so there will be no surprises?
Also, something to be aware of is that if you apply for financing at several places, do it within a 2 week time-span. Otherwise, all those inquiries will ding your credit slightly.
