ATM Transaction Dispute

I tried to make a $803 withdrawal from ATM, the transaction was cancelled but the funds were taken from my acct, the bank saying it was a vaild transaction. I've gong through my banks dispute department with no avail. The last thing I did was request settlement log from bank, I have not rec'd it yet, this transaction took place 2/20/09. I'm going to file a police report today and a small claims soon therafter, because I had to stop my direct deposit because the erroroneous transaction put my acct in negative and my payroll deduction was used to wards some of that , resulting in more of my money being tied up. All they wuld have to do is look at videotape and see that the cash door did not open during my transaction, therefore I was unable to take my cash, as instructed by ATM. I was told to take my cash twice but the door never open then I was told that transsaction was cancelled, saying they were unable to complete transaction at this time, then it gave me the option to make another transaction or get m card back. I rerieved my card and wentaround the corner to another bank to make $803 withdrawal because I was purchasing a car that day. I would like to know how I could get the tapes reviewed and by money returned .

We only have your side of the story, but it is difficult to believe that the Bank branch manager or another officer has not given you a response (perhaps one you do not like). One way to make it less likely they are not cooperative - try to file meritless criminal charges (who knows against whom, and for what claim).
