Legal Question in Credit and Debt Law in Georgia
An attorney has filed a lawsuit on my behalf. It's been 6 months and the defendant has yet to be served because she's out of the country. Is there a finite period in which the defendant must be served before the court will require me to withdraw my suit?

And why is this posted in credit/debt collection law? More importantly, if you have an attorney why are you asking lawyers here? First, its not really ethical for some other lawyer to interfere in your existing relationship with your attorney. The court does not make you withdraw your suit either. There are tolling provisions which might come into play. There aer also alternate ways to serve people. You do not indicate why the defendant is abroad. For good? Is he/she in the military and deployed? Where is the defendant at? There are ways to serve people who are overseas. You and your attorney need to have a little discussion about this.
