Hire a lawyer draft and file the documents yourself. Whether it is worth it or you actually might win are other questions, but you chose to not include facts.

When your credit card has a fradulent charge ytou do not charge anyone. Within 60 days (and preferably far sooner) you follow (EXACTLY) the steps on the back of the bill to dispute the chareg and the bank will remove fraudulent charges. Be sure to do the EXACT steps in your bill IN WRITING. Use certified mail, UPS or Fed Ex to prove delivery. Additionally CALL so they can cancel your card and send you a nw card with a new number.
