Legal Question in Credit and Debt Law in Georgia

Avoiding being served civil papers in GA

My mother has had a civil case filed against her for a credit card debt. She has become disabled and only collectes social security which is not enough to even live on much less pay past bills. She can not file bankruptcy as it has been less than 10 years since a previous bankruptcy.

She has simply been avoiding being served the court summons. She has now been threatened in writting with an arrest warrant if she does not pick up the summons or be available to be served.

Can this actually be done in the state of GA

Re: Avoiding being served civil papers in GA

A Chapter 7 can be filed if morre than 8 years have elapsed from the prior filing, not 10.

A person cannot be arrested for not being served. Report the collector, who has broken the law to say that, to the FTC at www.ftc.gov
