Legal Question in Credit and Debt Law in Georgia

Car Loan Debt

My son & his wife bought a car. Both their names are on the loan & title. They divorced & she took the car and moved out of state. She turned the car back in to Chrysler as a voluntary reposession, they sold it at auction. She informed Chrysler she is filing for bankruptcy in Georgia. If she files for bankruptcy and the car loan is included and then discharged, does my son in the military in Texas have to pay the amount left owing Chrysler? They sold it for 9000, & say he has to pay 20,000 more.

Re: Car Loan Debt

He needs to see a lawyer promptly.

He does owe the money under those facts. He can, in some situations, pursue her in the bankruptcy, but the car lender can pursue him.

His being in the military gives him some short-term protections he can discuss with a lawyer.
