Legal Question in Credit and Debt Law in Georgia
Chase credit card
I have two Chase credit cards. One has a balance of 10k and one 20k. This stems from business purchases several years ago. The business failed two years ago and I have been trying to make the minimum payments since. They raised the interest rate to 30%. I contacted Consumer Credit Counseling Service and they contacted all my creditors to start repaying on a monthly plan. Everyone accepted the plan except for the Chase with a $20k balance. They sent it to an attorney that will only take payment in full or they are going to sue me in 15 days. What will happen? Will I go before a judge? Can they garnish wages?

Re: Chase credit card
They can sue you, and once they have a judgment (that will take at least 46 days) they can then take 1/4 of your after tax pay, plus seize bank accounts.
Prior to a suit, you should probably discuss all your options (including bankruptcy) with a lawyer. In some cases a bankruptcy to wipe out (or pay) the debt may be a good choice. A lawyer might also help you reach a settlement.
