Collecting money for not filled purchase over the internet

I ordered merchandise at a company that I found over the Internet in another state. They said that the merchandise was ready for shipment and I wired them the money. As it turned out the merchandise wasn't available and still isn't. I asked my for my deposit and they replied that I can get it back any time, since they can't get me the merchandise. However, they keep promising to send the money back for 2 months now and still haven't sent a penny. The explanation is that it's the third party holding the money and that they can't get it back from the third party. My question is what should I do in this situation and how to avoid them filing for bancruptcy (they mentioned that they may go out of business) and me losing the money.

Unfortunately you can't avoid them filing bankruptcy. If they do, you'll get notice and you will have various rights. For now, however, I think you should probably see a lawyer about this. When a defendant is in another state, the rules can be somewhat complicated and you want to do things correctly, I'm sure. Good luck.
