Legal Question in Credit and Debt Law in Georgia

Collection actions

I have a medical debt that has gone to collection. I tried to set up a payment plan with the agent of 50 per month. He refused and told me the payment was inadequate. I sent he payment to him anyway. He then called my wife posing as the hospital and was rude and unprofessional. He threatened to ''take it as far as he can''. My question is, what actions can he take if I am sending him this payment EVERY month? Please give me an answer and not a number of a lawyer.

Re: Collection actions

If you owe the amount he is seeking, than they are not required to accept anything less than the full amount.

Re: Collection actions

Medical collectors tend to be ruthless. They do not have to accept payment plans and indeed you should not send any money without a plan as they will harass you more, believing the calls are working.

If the debt is large, the only way to stop such a collector may be bankruptcy.

If the collector chooses, they can sue you, garnishee your wages and attach your bank accounts.

If your debts are large and you wish to consider bankruptcy, you'll find a free worksheet at www.glenashman.com .

You can stop him from calling with a drop dead letter (Clark Howard has one on his site at clarkhoward.com )But that will usually speed up a suit.
