Legal Question in Credit and Debt Law in Georgia

collection agencies sued me

the statute of limitations on credit card debt in georgia. Is it 4 years or 6? I'm alarmed by a recent case(1-08) in the Georgia court of appeals, Hill v American Express where the judge ruled in favor of AMEX. Is a credit card account no longer considered open ended? I have been telling every collection agency who contacts me that their 4 years has expired. Can I still confidently do this?

No.

And your reliance on Georgia's statute is misplaced. Very fee credit cards use Georgia law as the specified law in the agreement. They often pick states with a longer statute.

"Telling" a collection agency about the statute of limitations does not stop their efforts and does not stop the filing of valid lawsuits -- even if it has expired (which, as stated, might be much longer than you think). They can try to collect forever. The obvious and best solution is to try to resolve your debts and obligations - perhaps they will settle on favorable terms.
