Legal Question in Credit and Debt Law in Georgia
Collection Agency
I have a credit card that has been turned over to collections. At the end of last November, I called and spoke to my representative and told him my debit account info had been stollen and asked that they not run anymore payments through. I just found out that I have had NSF's because they continued trying to use the account and ran up a $300 overdraft and my bank has been taking money from my current account to cover the overdraft fees. Is it legal for them to do process a check after I call a tell them to stop? I called and attempted to ask for a refund because another collection agency told me it was illegal for them to continue using the old account. The one who charged me, tried to tell me they did not keep records of what happened on my account when I used my old bank #. What can I do? Do I have a case?

Re: Collection Agency
From your post, it appears as though you failed to maintain basic oversight over your affairs. That will be your biggest problem in blaming someone else (even if you are initially correct). People don't "just find out" about months of overdrafts unless they don't check their accounts monthly. The matter should have been resolved on your end after the first overdraft (actually before, since you should have never given them access to begin with).
