Legal Question in Credit and Debt Law in Georgia
Collectors Renege on Payment Arrangements
Two months ago, I entered a repayment agreement with an attorney's office collecting a debt. They took my current financial and employment information and we agreed on a lump sum and monthly payment amount. I paid the lump sum as requested and sent the agreed upon monthly amount on time. (And, planned to continue sending it each month.) However, I now realize they did not send any letter confirming our agreement though they said they would. Just recently they began harassing me again at home and at work stating that their employee who had negotiated the prior arrangement was no longer there and the arrangement was unacceptable. When I objected to the recent turn of events, a supervisor confirmed on the telephone that the agreement did exist and was approved by the former employee's manager but they wanted more money because it would take too long to pay off the debt at the agreed upon amount. They are demanding that I make another lump payment or be sued. Is this a failure to honor an agreement and act in good faith? What recourse do I have? The company is in Georgia and I now live in Florida.

Re: Collectors Renege on Payment Arrangements
If they agreed to a certain payment schedule, they should be held to that. However, it sounds like they are not admitting that there was an agreement. It is a matter of he said, she said.
