co-sign for truck

My husband co-signed for a truck for our son. He is now behind with the payments. The company is threatening to put a lein on our house and/or have my husband arrested if he does not produce the truck.

Can they do either?

Also they call us two or three times a day. Is this legal or can it be harrassement?

People should never co-sign loans. As you found out, it means he owes the money.

Yes they can call him. Threatening to arrest him is illegal and should be reported at www.ftc.gov on their complaint form. And yes, if they sue you and get a judgment, their judgment would be a lien on the house.

You can stop them from calling with a drop dead letter (find one at www.clarkhoward.com ) but that increases the likelihood you will be sued.

Note that if they get the vehicle back, you probably still will owe a deficiency.
