Legal Question in Credit and Debt Law in Georgia

co-signer on loan Theft by deception?

I co -signed on a loan with wha i thought was a friend, we were going to start a lunch wagon business and my credit was good but she couldn't get any. o.k. the loan was for approximately 7700.00 and i co-signed. Now, she took the money bought the r.v. annd had the title put in her namee without my knowing anything about it. Then she disappears. to make a long story short. She took it to a titlemax and got a 2000.00 loan and left it. I took her to court and won the judgement and found that she packed up and moved to FL where whe was getting paid cash for cleaning services. Now, I ask the judge if I could press charges against hr for theft by deception and he said he could only guide me not tell me what to do, but: if i did it would be a felony. Now, what I am wondering is: can I, this fiasco nearly caused me my marriage. Please, what to do? thank You

Re: co-signer on loan Theft by deception?

You fail to state what she "stole" from you. If you merely co-signed for a loan for her, you likely had no rights to the loan proceeds or the property bought with the proceeds. Typically, co-signer have all the risk and no rights to the loan proceeds or items purchased. You fail to state whose name the RV was supposed to be in, if not hers alone. How would criminal charges against her lead to you getting your money back? These are questions to consider.
