Credit Card Debt

My daughter had a credit card in her name alone. She got me a card on the same account. I bought all that was bought on the card. When I had financial problems and got to where I couldn't pay the payment, the credit card company set up a payment plan for me to pay $55 a month on the $1700 balance until it was paid for. I did that for a few months. Then I started getting statements from them again where they were adding over the limit fees, etc. every month. The balance just continued to go up so I stopped paying them. I did not receive anything for a few months and then suddenly I got calls from a lawyer threatening to sue me. My daughter also got the calls. The $1700 balance I had been paying had gone up to $2600. I am paying the lawyer $50 a month. I live in Georgia. The lawyer is in Massachusetts but has offices at other locations. Neither my daughter nor I have ''jobs'' but our husbands do. However, their names are not on the card. I would like to know if this lawyer can sue us. I am having a hard time paying this $50 every month to a lawyer that I did not owe in the first place. By the way, his name is J. Anthony Cambece.

The bottom line from your post is that you and your daughter made purchases (or at least you did), defaulted on the payments, and are now being threatned with a suit. I am not sure why you think you can't be sued - that is generally what happens when people default on debts (and yes, the person who made the charges can often be sued even if they are not the account holder). You may not "owe" the lawyer, but the lawyer represents the party you do owe. Perhaps between the four people mentioned, this debt can be honored.
