what do I do if credit card debt has been turned over to the court, can I declare bankruptct?

Martin's answer is partly incorrect.

Assuming you are eligible for bankruptcy and file a case before it goes into default it would be unnecessary to answer the complaint as the bankruptcy stays the action. Bear in mind the case goes into default 30 days after filing so you have to ask quickly. (You do need to answer otherwise).
