Legal Question in Credit and Debt Law in Georgia

credit card debt wage garnishments

Hello, I have a question can is there a statue of limitations on collecting a credit card debt? If the card account was opened in 2000 in the state of FL. and now here it is 2007 and live in Ga. and be threatened of garnishment wages. Can that really happen, even if a response was sent in with the first summons sent for a judgement in 2007 explaining the circumstances and how much could be paid possibly monthly. Now it is going to the point of wage garnishment. It just unbelievable, don't they understand if the money was there to begin with it would had never gone so far. Can wages be garnished even if there is one sole provider of the household and making it on a pay check to pay check basis raising four children and two with special needs. What other options are out there if any?

Re: credit card debt wage garnishments

If you already have lost a court judgment (and your very confusing post makes it impossible to tell) it is too late to present defenses and a garnishment can be done in Georgia for at least the next 7 years, and if renewed, longer. Your income and needs are not considered in garnishment. If you are facing garnishment, a bankruptcy may stop it and you should talk to a lawyer and see if that is an option.
