Legal Question in Credit and Debt Law in Georgia
Credit card Liens
My husband was injured five years ago. We were unable to pay any of our bills. We have been struggling to pay off all the back debts. Two years ago my husband was served at work for one of our credit cards. We couldn't pay the whole thing at once and they wouldn't work with us. Last month they got a judge to allow them to freeze our checking account. Now we got a letter from them telling us we can settle the balance for 70% off. My question is can they get a second judgement on the same credit card?

Stop talking with the creditor and do what you should have done two years ago when he was first served - hire a lawyer. There are possible adverse tax consequences if you settle a debt, and in allowing the case to go to a judgment, you reduced your options. You need a lawyer immediately, as you may still have some ways to eliminate or address this debt. Feel free to call me to discuss details.
Re: Credit card Liens
What second judgment? You only mention "served at work" then to two years later freezing your checking account. You also do not say whether you can afford to settle the 70%, so it is not clear what your true question is. If you can settle it, get an agreement in writing and settle it. Offer what you can. If you can continue to whittle down your back debt, there is no reason to find way to eliminate your debt (the magic word - bankruptcy) and pay lawyers instead of your debts.
