Dead beat Co-signer

I co-signed along with my boyfriend at the time on a car note 2 yrs ago. I recently received a summons that I'm being sued by the bank for non-payment. My ex is nowhere to be found and he still has the vehicle in question. Why is my name only mentioned in the lawsuit when we both signed for it? How should I respond to the summon?

The bank can pursue one or both of you, at its own discretion. The prudent way to respond would be to retain a lawyer, or apply that money toward a settlement.

Any time you cosign a loan you are agreeing to pay the whole thing. They can sue just you. Since a judgment will probably happen soon, you should see a bankruptcy lawyer, if the amount is large, to see if that would protect you. If ytou're in metro Atlanta, call us.
