Legal Question in Credit and Debt Law in Georgia
Debt Collectors and Child Support
Hi, my ex has hired a collection agency, Support Collectors, to try and receive back child support she says I owe. We came to an agreement in 2002 about the support and now that I have a medical malpractice suit for the loss of my right eye she is claiming I owe her. The collector I am dealing with states that he does not need to send me any written confirmation of this claim and because he is in contact with my malpractice attorney, he doesn't need deal with me. He also claims that a lien can be placed on my settlement, should I receive any, and can be placed without a court order of any kind. Also, I believe that my ex has not sent the collector any correct information about our support case. Would you please tell me if what this collector is doing is legal, what my rights are, and what the collector is allowed to do to me to collect anything?

Re: Debt Collectors and Child Support
Unless a judge approved your "agreement", it doesn't exist. You owe what your paperwork says you owe, and a lien may be possible. Whether additional court orders are needed depends on information we don't have here. You are way past self-help in this situation and need a lawyer.
