Legal Question in Credit and Debt Law in Georgia

Deceased father's credit card debt

My father passed away recently. He had a $14K outstanding balance on a credit card held solely in his name. The bank sold the debt to West Asset Mgmt and they have been calling my mother to arrange settlement of the debt, offering to settle for $9.8K paid in full. My father left no estate. My mother was beneficiary on a $25K ins policy. Their house was in both names and has an outstanding $27K equity loan. (I believe the house has transferred to my mother under joint tenancy with right of survivorship). Outstanding car loan of $21K, now in my mother's name and 2 other credit cards in both names with $3K and $2K balances, respectively.

Does she have responsibility for $14K credit card now held by West Asset Mgmt? Can they place a lein on her house, etc?

Re: Deceased father's credit card debt

I don't have enough details to answer you. She should not talk to the creditor until she sits down with a lawyer, and it would be smart to let the lawyer respond.
