Legal Question in Credit and Debt Law in Georgia
I was in default for the payment to my Capital One credit card. I closed the account and I couldn't make the payments for a while. I kept getting letters but they kept on adding ridiculous fee's & interest. I disputed the amount on my credit report which is still pending. I was served with court papers from an attorney; for a demand of payment. The card high limit was only $500. They are asking for $1044. What do I do? The court papers state I must do something within 30 days. Any help would be appreciated.
1 Answer from Attorneys
You owe those fees. (Read your credit card agreement). You have three choices:
(1) Do nothing and they will soon garnishee your paycheck. (or pay a lawyer a lot more than $1044 to answer, and you probably will still lose)
(2) Pay them $1044 plus interest and costs in exchange for a dismissal.
(3) File bankruptcy of you are eligible.
Regardless, you now have 30 days as a deadline. (Disputing an accurate debt on your credit report was a waste of time). Now you need a lawyer.
