What is the difference between pursuing a debt ($1,100 for typing services) in small claims or a collections agency and using a Theft of Services warrant?

In general (since we have zero facts), one is a legitimate way to collect a debt and one is a good way for the creditor to risk sanctions, or even arrest, for making a false criminal complaint and turning a collection issue in to a criminal issue.
