Legal Question in Credit and Debt Law in Georgia
Divorce and credit debt
My husband move out of our home but still pays the mortage. I do not know where he lives or works and he does not answer his cell phone. We have a 15 year old at home with me. I took out credit cards in his name with me as an authorize user to pay the bills. I work. If we divorce is he responsible for half? Can I go to gail for doing this.

Re: Divorce and credit debt
If you are an authorized user of the credit cards, then making purchases, paying bills, etc. is not illegal. How the property would be divided up in a divorce is decided on a case-by-case basis.

Re: Divorce and credit debt
You need to retain legal counsel immediately. You can't go to jail for not paying bills, but your husband can go to jail for not paying child support, if he isn't (even if no court has yet ordered it). As for who pays bills in a divorce, it is not necessarily 50-50; that must be decided in each case.
