No one here knows anything your financial situation, and you did not even bother to say how many payments behind you are, the equity in the vehicle, and all other relevant facts. DO you qualify for a Chapter 7? We don't know. Call a consumer bankruptcy lawyer in your area to discuss all facts.
As noted by Attorney Riddle, you leave a lot of information unanswered. The decision whether you should keep the car or relinquish it depends on your circumstances. Assuming that you qualify for a chapter 7 bankruptcy, if you are behind on your car payments, you will need to figure out a way to catch up on the payments if you are behind, usually within 30 days after filing the bankruptcy petition. If you want to stretch it out longer, you may have to do a chapter 13 bankrutpcy.
I echo Attorney Riddle's advice. Many many attorneys do bankruptcy; some will even do free consults. If you do not already have one, find one. If you have one, its not ethical for me or any other attorney to be discussing this situation with you, especially when we do not have the information about your debts and assets.
