This is not a collection question. If you have been charged criminally, you need to seek out a criminal defense attorney NOW.

The punishment will depend on (a) what you are actually convicted of; and (b) whether you have a prior criminal record. Doubtful that you would do serious jail time or any jail time if this was a first offense. However, if the facts truly are as alleged, a good criminal attorney should be able to get this resolved if you make restitution and cooperate with the police.

And why would you accept a stranger's offer to pay for your gas? Didn't your mother ever tell you not to deal with strangers?

People do not offer to pay for gas for others. Next time, just say no thanks. Your "free" gas has now cost you an arrest on your criminal record, a criminal defense attorney and possible criminal sanctions if you are convicted.
