Legal Question in Credit and Debt Law in Georgia

I have found out that my wife has for the past 5 years re-routed my mail to a UPS Store PO Box to hide her clandestine fraud. She has depleted my savings account which has had my VA Disability Checks going into that account since 1993! I also have found out that she rented out my inherited land left to me by my father in Texas for the past 5 years as well. My wife has ruined my credit to where I cannot buy a car, rent a car because she used my credit cards without my approval. I have filed fraud in my county and the DA says she will not act! I have filed for divorce in the county and seems to me that my inept lawyer is not equipped to handle this. Instead my lawyer is treating this as a simple divorce? There is more to this, I have the documents, affidavits supporting this fraud. Do I call the FBI? Please someone, I am at such a loss here. I need some real legal advice and I need a take charge lawyer. So far here in Georgia all I have seen is ineptness in lawyers and the Georgia Laws. I am ready to pay to have this legally submitted and have her tried. Thank you!

If you are not happy with your current lawyer, either get a second opinion from another lawyer (usually paying for a couple hours time), or hire another lawyer. You don't have anything to be addressed on a website like this.

No, you do not call the FBI. The FBI handles federal issues or issues which cross state lines. There may be fraud here but the district attorney has the discretion whether to prosecute or not. Frankly, one guy being taken advantage of by his wife is not going to be very sexy to a district attorney. That is not news and will not sell newspapers or help the district attorney's political career. You can try talking to the head district attorney or seeing whether there is some mechanism to appeal the district attorney's decision to a judge. However, unless the ex-wife bilked others, I just don't see how a district attorney can be forced to prosecute here. Their resources are finite and they are more concerned with other kinds of cases unless a lot of victims and a lot of money is involved (like the Bernie Madoff case).

If you have an issue with the soon to be ex-wife, you could sue civilly but since you are getting divorced, this all needs worked out in equitable distribution.

You need a more aggressive family law attorney. The problem is, that if your ex-wife gets very little in the divorce court and has no real assets, she is never going to be able to pay you back. Its not fair - I know you want your pound of flesh out of her but I am being realistic here. You may not be able to get it. If that is the case, do the best you can in family court and chalk it up to a "life's not fair category." Life is not always fair and sometimes it really really sucks. But you learn from your mistakes and you move on.
