Legal Question in Credit and Debt Law in Georgia

My friend owns a landscaping business. He purchased plants, etc from a plant nursery back in 2001. He had a balance owed when the man closed/sold his business. He is trying to get money from my friend and charge interest on everything that was owed. Can the nursery owner just decide to charge interest after the fact without a signed contract stating interest will be added monthly?

If the man sold his business, then your friend owes the "new" business owner, not the "old" business owner. Even if he did owe the original owner, if the man closed his business for over 10 years, he will have a VERY difficult time enforcing that debt in Court. If I were your friend's lawyer, I would politely tell the man to go away. If he files a lawsuit against your friend, your friend is in pretty good shape based on what you have stated above.

Best of luck.*****The above is for informational purposes and does not create an attorney-client privilege.*******
