Legal Question in Credit and Debt Law in Georgia
Garnishment
My checking and savings account was completely wiped out without any notice b/c of a garnishment. I have a joint account with my boyfriend who has nothing to do with the debt that is owed, but everything in the account was taken out. I have a 5 year old son, and am concerned about how we will pay bills, get gas, food , etc...Please explain the law to me! Do I have any protection against this!

Re: Garnishment
A joint account is deemed the property of both of you - not based on how much you put in, or 50/50. Therefore, a joint account can be garnished. The specific amounts and whether it is otherwise proper depends on facts we do not have. Your best "protection" is avoid the circumstance (judgment, garnishment) in the first place by, at the very least, working out a payment plan. Otherwise, your boyfriend obviously needs the protection in the form of seperate accounts.
