Legal Question in Credit and Debt Law in Georgia

garnishment

I hope you can help me with this question. If not, thanks anyway. I was served with garnishment papers several months ago about a credit card debt. I replied to the attorney through the court here in Gibson via certified mail. I asked for some kind of proof that I had this card debt. The only reply I received is that I signed for a credit card. I sent several certified letters asking the attorney for something, as in an application or individual bills that I signed. No reply. I have no knowledge of this debt. I have had 2 small strokes and I have no job. laid off last week. Anyway a judge in Thomson signed an order for garnishment. My ex employer called me, plus I received another certified letter stating that I would be garnished. I am now in a position that if I can get another job I will be garnished. That will be the end of that job. Any help with an answer will ne most appreciated.

Thank you

Re: garnishment

A garnishment only happens after you lose a lawsuit, so you are asking this question way too late. You already lost a court case (likely through ignoring it, possibly even many years ago). The ONLY ways to stop a garnishment are to (1) pay off the debt, or (2) go bankrupt. See a lawyer ASAP, and do NOT keep contacting the collection attorney, who has a duty to his client to use everything you tell him against you. That is the single worst thing you can be doing.

If the debt is large and your income limited, a bankruptcy MAY be a very good option. Feel free to call me if you are interested in this and are in the metro Atlanta area.
